A.  Danielle Larson of Lilac Blossom Photography will provide the following service with all fees due at the completion of the session:  

 

A 30 minute family mini-session on a selected date. This session is for immediate family members only - not for extended family or more than one nuclear family.  The exact meeting spot will be confirmed once the session is booked. 

 

In the event of inclement weather, the raindate is the next day, Sunday and will be scheduled automatically for the exact time slot. The client agrees to keeping this spot available or will risk forfeiting their deposit.  If that date is also forecasted to be inclement weather, a rescheduled date will be made at the convenience of both the photographer and client. Raindate decisions will be made within 24 hours of the scheduled session date and time. 

 

Due to the custom nature of this service, no returns are possible. The fee for this service is $350. A $150 deposit, along with this signed contract is required to book. The balance of $200 is due at the time of the session.

 

If the client cancels prior to the session, the deposit is forfeited as it held the time slot, preventing another booking from being made. It cannot be applied to a future session. 

 

Online proofs will be available on a password protected gallery on the website within 3 weeks of the session.  Clients will access the private gallery provided by the photographer via email.  This gallery may be shared by the client with friends and family, if they choose to do so.  However, screenshots from the gallery are not permitted.

 

The client must choose 10 of his/her favorite photos from the proofing gallery for digital download within two weeks of receiving the online gallery.  After which time, the gallery automatically expires and a fee will apply to activate the gallery once again.

 

Additional photos from the proofing gallery are available for download at a cost of $30 per file or for a total of $200 additional for the full gallery. 

 

Professional printing packages are also available upon request at an additional charge but are not necessary as part of this session.

 

The client may print photos as they wish and permission to do so is granted with this contract.  

 

 

B. Raindate / Re-shoots / Refunds

We will do our best to keep the scheduled session on the date and time requested, however, in the event of inclement weather, the raindate will be scheduled for the next day, Sunday, that weekend.  Please make yourself available for both days in case of the need to reschedule.  You will be contacted about a week prior to the shoot to confirm your session date, time and location and in that email, a contingency plan for inclement weather will be made.  If you are not able to attend the raindate, no refunds will be granted, but your deposit will be applied to a future session, good for up to one year from the scheduled session date.  Refunds are also not given due to last minute cancellations on the part of the client.  Your deposit holds your spot, which prevents others from booking, so the deposit is non-refundable. 

 

Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for uncooperative family members, poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer.  The photographer will do her best to provide the best possible shots, but nothing is guaranteed.   

 

 

C. Archive

After six (6) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.

 

 

D. Payment

All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. Payments methods accepted are cash, check (payable to Lilac Blossom Photography), Venmo, Paypal or credit card.   NYS sales tax will be added to any product orders (including but not limited to: USB flash drives, prints, wall mounts, and books.)

 

 

E. Other 

All images are copyrighted by the photographer, Danielle Larson, of Lilac Blossom Photography. A print release will be given for all digital files so you may print them as you wish.

 

Minor retouching is complimentary as part of the editing process. Extensive retouching (such as head swapping, removal of tattoos or other major retouching) is available for $35 per image. 

 

Print orders will be ready approximately 2-3 weeks after the order is paid and will be mailed to you.

 

In the interest of fairness to all of my clients, I am unable to offer special deals or discounts except for those that may run occasionally as promotions.  For this reason, please understand that session fees, print prices and policies are non-negotiable.

 

F. Model Release

I hereby give to Danielle Larson of Lilac Blossom Photography the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself and/or my minor child in which she may be included with others:

 

a) To copyright the same in the photographer’s name or any other name that she may select;

 

b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;

 

I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.

 

 

G. Liability

Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

 

 

H. Copyright & Penalty

Lilac Blossom Photography retains all copyrights to all images created during client’s session. A print release will be provided with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Lilac Blossom Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file.

 

Note from photographer: I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity. I know you will want to share them and include a sneak-peek for that very reason. However, I ask that you simply link back to my blog/website/facebook page instead of right-clicking, saving, and sharing the image via your own page. I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you. Please do not steal them.

 

 

I. Session Requests

*No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer, including a written agreement. The photographer will not continue if there are other cameras or video taping during the session.

 

*Please do not bring any children not being photographed to the session.

 

*Please make sure hair is combed and face is clean and free of runny noses or eyes.

 

*Please avoid eating or drinking red or orange food or drinks before session, as red and orange tend to leave a stain on the face.

That you have read and understand the terms of this portrait contract with Lilac Blossom Photography. 

 

You understand the rain date for the session is the very next day (Sunday) at the same time and I must be available for both dates and times. 

 

You understand that my session is not booked until the session fee payment is paid. 

 

You understand that my session is ONLY for immediate family (spouse and/or children.) No extended family members are to be included. 

 

You understand my reservation and deposit is non-refundable and cannot be applied to a different session, date, or time. If you cancel the session, you agree to forfeit the deposit.
